The former Pullman Police Sergeant accused of sexual misconduct will not be retried.
49-year-old Dan Hargraves stood trial for felony custodial sexual misconduct in Whitman County Superior Court last month. The trial ended with a hung jury 7 to 5 to convict.
Hargraves was accused of coercing an 18-year-old WSU student into performing a sex act on him. The alleged misconduct occurred while the female was being detained for an alcohol violation in March of last year.
Whitman County Prosecutor Denis Tracy announced Thursday that he is dropping the case and will not retry Hargraves. Tracy says the victim is unwilling to testify again and he will not force her to cooperate.
Hargraves was arrested a year ago on the felony and he resigned from the PPD a few weeks later.
