After years of litigation, the Idaho Transportation Department is moving forward with plans to expand U.S. Highway 95 to two lanes in each direction from Thorncreek Road to Moscow.
The U.S. Court of Appeals for the Ninth Circuit ruled in favor of ITD and the Federal Highway Administration on Friday during the latest appeal of the highway’s expansion.
The Palouse Ridge Defense Coalition submitted a lawsuit against the FHWA and ITD regarding the project’s Environmental Impact Statement and Record of Decision in April 2017, which claimed the highway’s expansion would cut through a section of Paradise Ridge and lead to loss of wetlands, remnants of Palouse Prairie, farmland and conservation reserve.
B. Lynn Winmill, Idaho’s chief federal judge, ruled against the motion and in favor of the FHWA and ITD in August 2017, but the coalition appealed Winmill’s judgment.
The expansion would make all of U.S. 95 between Moscow and Lewiston two lanes in each direction.
