In a case that may have repercussions for a post-Janus world, the Michigan Supreme Court ruled that the Michigan Education Association could not limit member resignations to a window in August.
The case worked its way through the legal system after the state employment relations commission ruled in favor of four plaintiffs who wished to resign the union immediately. The state court of appeals also ruled in favor of the plaintiffs and the state supreme court’s decision to deny MEA’s appeal effectively closes the case.
The ruling may have wider significance since a number of teacher unions are urging members to sign new membership forms that require them to pay dues in perpetuity unless they resign during a designated window. If the U.S. Supreme Court rules in favor of Janus, the issue of resignation windows will be one of many side-battles that will erupt in its wake.
