I’m no fan of torture. But prosecuting the psychologists and exempting everyone else is like prosecuting the guards at Auschwitz but giving the entire Nazi SS hierarchy a by.
If they want to prosecute this, start at the top and work their way down.
The lawsuit over detainee torture against two Spokane psychologists, James Mitchell and Bruce Jessen, who helped the CIA develop interrogations techniques will go forward, a federal judge ruled on Monday.
U.S. District Court Judge Justin Quackenbush issued his ruling Monday after he openly questioned the legal justification in a hearing on July 28 to move forward to trial on behalf of Sulieman Abdullah Salim and Mohamed Ahmed Ben Soud, who were suspected terrorists subjected to torture by the CIA in the early years of the war on terror.
Evidence suggested that Jessen personally participated in the interrogation of Gul Rahman, who was placed in a diaper, short-chained to the floor, and died of hypothermia in his cell.
But Quackenbush’s ruling appears to clear the path forward on behalf of three men, who were named in a civil suit brought by the ACLU. The trial is scheduled for Sept. 5 in Spokane.
